Those involved in advising on enfranchisement and new lease claims often find it useful to consider alternative approaches when helping leaseholders achieve their goals. The statutory right to manage is one such alternative as it can provide the control of the management of the building they desire without having to fund a freehold purchase. As a no-fault based right it can be very straightforward but, as seemingly endless court and tribunal decisions show, great care must be taken at the preliminary stages. This talk will demonstrate how important it is for practitioners to be familiar with what the RTM can bring and how it can be achieved.
The Middleman’s Tale – presentation by Jennifer Ellis FRICS, Senior Partner, Langley Taylor, with legal commentary from Mark Chick, ALEP Director
Jennifer’s talk will cover the importance, role and standing of those owning intermediate leases and how they are compensated when their interests are diminished.

The invitation to Westminster comes after ALEP played a key role in legislative reform, which resulted in the amendment to the 1993 Leasehold Reform, Housing and Urban Development Act being passed earlier this year, and confirms ALEP’s place at the forefront of the leasehold and enfranchisement industry.
Lord Ahmad of Wimbledon presided over proceedings, with the government represented by Brandon Lewis, MP, Minister of State for Housing and Planning at the Department for Communities and Local Government.
The agenda covered a number of topics currently facing the residential leasehold sector and included an overview from the Minister on the government’s current focus and action.
Matters discussed of particular interest to ALEP and its members included the issue of freeholder valuations with specific regard to counter notices, a planned health check for prospective leaseholders to support advice already available and discussions between the DCLG and LEASE regarding (paid-for) access to Tribunal decisions.
Alex Greenslade impressed upon the party the importance of considering long-term issues, particularly the matter of lease length, as well as those that might result in immediate resolution. He was also able to present the Minister and delegates with ALEP’s wish list of enfranchisement sector changes, as drawn up by its members over the past four years.

The 15th ALEP Conference took place on 21 October at the renowned Royal Institution in Mayfair.
A sell-out success, the conference – once again sponsored by Kerry London – welcomed over 250 delegates, demonstrating just how far the Association has come since its first event, which played host to just 40 guests.
Many of the delegates represented ALEP’s 170 member organisations, and were joined by peers from the wider property sector and the press.
ALEP is committed to promoting best practice specifically in the enfranchisement sector and prides itself on being progressive, innovative and responsive to member feedback. As a result, breakout sessions were reintroduced for this landmark event, which enabled delegates once again to specialise by attending either a valuation or legal masterclass.
Mark Chick, ALEP Director and Partner, Bishop & Sewell, hosted the event, which began with a session on Schedule 10 and its application to enfranchisement valuation, presented by Katherine Simpson, Partner, Head of Residential Real Estate, Pemberton Greenish.
The valuation masterclass was led by James Wilson, Partner and Head of Valuation, W.A.Ellis, who led a discussion and lively Q&A session in the Faraday Theatre on current valuation topics, including recent case decisions. Mark Loveday, Barrister Tanfield Chambers, took charge of the legal masterclass and introduced the topic of missing landlords, vesting orders and the alternatives, to 100 delegates in the Conversation Room.
Afternoon tea and more networking was followed by a presentation from Sophie Chick and Chris Buckle of Savills Residential Research team. Both speakers impressed delegates with an excellent and informative presentation, which covered current market conditions in the UK residential property market, and key research issues, including use of indices and factors affecting relativity.
Philip Rainey QC, always a popular speaker, gave the traditional case update presenting an overview of some of the most important decisions in recent months and assessing their impact on the enfranchisement sector.
ALEP announced the imminent launch of a new website, with improved features for consumers and members, and also updated delegates with news of the Association’s involvement in further lobbying of parliament about leasehold matters.
